1. This pertains to the arrest of, accused BARRY RAYMOND EDWARDS, 59 years of age, British National, a retired Professor of Middlesex University, London, England with postal address at #3001 Wingletye Lane, Homchurch Essex, RM 113BU UK, who was arrested on or about 181000h June 2004 at his rented cottage at Room #20, Seashore Lodge, in Sabang Resort, Puerto Galera, Oriental Mindoro by virtue of Warrants of Arrest in Criminal Cases 03-6911 and 04-098 for Violation of Sec. 10 (b), Art. VI of RA 7610 and Criminal Case Number 04-242 for Violation of Art. 201 of the Revised Penal Code, issued by the Hon. Judge Ofelia Tuazon-Pinto, the Presiding Judge of RTC Branch 60.

BARRY RAYMOND EDWARDS was, first arrested by elements of Police Station #4
and Women and Children and Concern Section (WCCS), this Office on or about
241600H July 2003 when he was found inside his rented suite at Room #15 of
Maharajah Hotel, Villasol Subdivision, Bgy Anunas,, this city alone with a
14 year old girl named MARIA FLORES y lbeya, of Bgy Agapito Del Rosario,
Angeles City, a minor who is not his relative.
This in itself was a violation of the provision of Republic Act
7610 particularly of Art VI, Section 10, paragraph b which states
"Any person who shall keep or have in his company a minor, twelve
(12) years under or who is ten (10) years or more his junior in any public
or private place, hotel, motel, beer joint, discotheque, cabaret, pension
house, sauna or massage parlor, beach and/or other tourist resorts or
similar places shall suffer the penalty of prison mayor in its maximum
period and a fine of not less than FIFTY THOUSAND PESOS (P50,000,00)...
"Furthermore, at the time of his arrest, the apprehending officer saw
in plain view, an amateurishly done film running in the TV set in which
the scene being shown was an actual sexual intercourse of EDWARDS and
another minor who was later on identified as EVA MAGUIGAD y Umpad, 17
years of age, of Bancosay, Hensonville, Bgy Malabanias, Angeles City.
Likewise, stocks of VHS Tapes were found in one corner of the room
and when viewed, it was found out that each tape contains scenes showing
EDWARDS having sexual intercourse with different partners mostly with
girls of minor age. The VHS
Tapes and other equipment used by EDWARDS in shooting the immoral films
were confiscated EDWARDS with the confiscated evidence were later on
brought to WCCS Office for further investigation and proper disposition.
MARIA IBEYA FLORES was interviewed and she executed her sworn statement
narrating among other things that before the arrival of the apprehending
policemen, EDWARDS was able to have sexual intercourse with her, Although
what happened ms against her will, he succeeded in fulfilling his evil
desire because she was intimidated by his size and strength. Thus, a case
of RAPE in relation to RA 7610 was filed before the Prosecutor's Office
against EDWARDS docketed under IS Number 03-G-3241.
When the case was presented for Inquest Proceedings on July 25,
2003 EDWARDS availed of his rights to Preliminary Investigation and in the
presence of Atty. Salvador S Hipolito of Public Attorney's Office, he
signed a waiver of Art 125 of the Revised Penal Code. Later on that same
day EDWARDS was turned over to Angeles City District Jail for detention.
On August 4, 2003 EDWARDS submitted his Counter Affidavit vigorously
denying the accusations against him. The Investigating Fiscal, the Hon.
Ruben C. Hilario, 3rd Assistant City Prosecutor submitted his RESOLUTION
dated September 16, 2003, duly approved by the City Prosecutor,
recommending the dismissal of the case after he found no prima facie case
against EDWARDS for the crime of RAPE and for the immediate release
EDWARDS from detention.
EDWARDS was subsequently released from Angeles City District Jail.
On September 30, 2003, the Chief, WCCS, PSINSP ERLINDA TULLAO
TULLAO filed a Motion for Reconsideration with a prayer of inhibition of
Prosecutor Hilario from further handling the case.
Because Pros. Hilario inhibited himself from the case on October
21, 2003, it was assigned to Second- Assistant Prosecutor Lucina A Dayaon,
who on October 21, 2003, in reaction to the Motion for Reconsideration
filed by the Chief WCCS, submitted her RESOLUTIONIRECOMMENDATIONS
finding probable cause to hold EDWARDS for trial not for RAPE but
for Violation of Sec 10(b), Art VI of RA 7610. On October 28, 2003 the
City Prosecutor's Office through Prosecutor Dayaon filed the corresponding
INFORMATION accusing BARRY RAYMOND EDWARDS.
This particular case was raffled to RTC Branch 60 under Criminal
Case Number 03-691.
3.EVA UMPAD MAGUIGAD and another minor, a 17 year old girl named RAQUEL ROBLES SAPUNGAN, of Purok 4-B, Sto Nino, Bgy Pampang, Angeles City also complained of having been raped by EDWARDS. Maguigad averred that on June 8, 2003, EDWARDS had sexual intercourse with her inside his room which he recorded through a video camera. This was repeated on June 12, 2003 wherein after having sexual intercourse with her, he paid her P1, 000.00. While SAPUNGAN narrated that EDWARDS had sexual intercourse with her and a certain REA on July 19, 2003 inside his room. MAGUIGAD's complaint was dismissed by the Investigating Fiscal, the Hon 3rd Assistant City Prosecutor Ruben Hilario in his RESOLUTION/ RECOMMENDATION dated September 17, 2003. But in so far as SAPUNGAN'S complaint is concerned, the same Assistant Prosecutor in his RESOLUTION/RECOMMENDATION dated February 2, 2004 recommended the filing of the corresponding INFORMATION against EDWARDS not for RAPE but for Violation, Sec. 10(b), Art VI, RA 7610. On February 4, 2004, the City Prosecutors Office through Pros. Hilario filed the INFORMATION dated February 2, 2004 accusing BARRY RAYMOND EDWARDS under Criminal Case Number 04-098.
4.On August 7, 2003, the WCCS filed a case-before the City Prosecutors Office against EDWARDS for Violation of ART 201 of the Revised Penal Code. The 3rd Assistant Prosecutor, the Hon. Ruben C Hilario handled the case for Preliminary Investigation and on March 25, 2004, he submitted his RESOLUTION/RECOMMENDATION finding prima facie case against EDWARDS for Violation of ART 201, paragraph 2 (b) (2) and (5) of the Revised Penal Code. Thus, the corresponding INFORMATION was filed under Criminal Case Number 04-242. Both of the last two cases were also assigned to RTC Branch 60, the, presiding Judge eventually issued the corresponding Warrants for the arrest of said accused.
5. Meanwhile, this Office continuously gathered information for the whereabouts of the accused who seemed to have gone into hiding. On June 17, 2004, Fr. Shay Cullen of PREDA Foundation Inc., informed the City Director, PSSUPT JIMMY FAJARDO RESUTA that the accused was to be found in Puerto Galera. The City Director wasted no time and on that same day, he organized a team composed of PSINSP MARIA CRISTINA, L BERNARDEZ, P03 EDSEL C BAUTISTA, P03 RAQUEL F TABULA, P02 ROLDAN M..TABABA AND PO1 ARNEDO PINEDA purposely to serve the Warrants of Arrest: At about 17l200h June 2004, the police team led by PSINSP BERNARDEZ, accompanied by Mr. Robert Garcia of PREDA Foundation, left for Oriental Mindoro and on 181000H June 2004, accused BARRY RAYMOND EDWARDS was finally arrested at Room #20, Seashore Lodge, Sabang Resort in Puerto Galera.
6. EDWARDS is temporarily detained at this office pending the issuance of a commitment order by the court.
