JOINT AFFIDAVIT
WE, the undersigned co-affiants, all Fiipino citizens, of legal age, and with respective postal addresses indicated hereunder, below our respective signatures over printed names, having sworn to in accordance with law, hereby jointly depose and say:
1. We are all gainfully employed/self-employed and are leaders of our respective civic/community/grassroots/urban poor organizations as indicated hereunder, as below our respective signatures and printed names.
2. We are very much aware and cognizant of the disqualification controversy or issue against Vice-Mayor CYNTHIA G. CAJUDO and Councilor GREGORIO "Yang" ELANE of Olongapo City who were both reelected during the recently conclude 14 May 2001 Elections, the former having recently assumed her office for her 4th consecutive term, and the latter having also recently assumed his office for his 5th consecutive term
3. We at-c also aware and cognizant of the three, (3) consecutive term limit fixed harder Section 8, Article X, 1987 Philippine Constitution, and reiterated under Section 43, paragraph (b), Local Government Code (Republic Act No. 7160, as amended) for local elective officials.
4. The general electorate or registered voters of Olongapoo City are more or less aware of the fact that Vice Mayor Cajudo has served her third and consecutive term of office upon her completion of the term 1998 to 2001, and Councilor Elane his fourth consecutive term of office upon his completion of the term 1998 to 2001. However, with temerity and alacrity, the vaunted Spouses Gordon local political machinery, which have overwhelmingly dominated the local political scenario at Olongapo City for several and long years, re-included both Cajudo and Elane in their line-up for re-election to their long-held local elective -Positions this 2001 Elections, and both re-el6ctionists acceded despite their full awareness of their disqualification or ineligibility for re-election as they stoutly believe in and rely upon the much-ballyhoed invincibility of the Gordon ticket in Olongapo City.
5. Incidental to or necessarily because of our respective organizational Positions and involvement, and our extensive public exposure therewith, we honestly and strongly believe that those of the general electorate of Olongapo City who insisted and persisted in voting the ineligible re-electionists Cajudo and Elane during the last Elections largely knew all the while of such ineligibility due to said term limit proscribed under the Constitution and expressly prohibited by statutory provision. Perforce, their votes in favor of said re-electionists should be nullified because the validity and efficacy of their said votes are deemed by law and jurisprudence to have been waived by their insolence and indifference. Consequently, we earnestly believe that 2nd placer ARIEL "AJ" C. SALIBA, official candidate of the Laban ng Demokratikong Pilipino (LDP) for Vice-Mayor of Olongapo City during the same elections, deserves to be proclaimed as the lawful winner of the vice-mayoralty race in the same city.
