REPUBLIC OF THE PHILIPPINES THE PEOPLE OF THE - versus - CRIM. CASE NO. 02-80 CAMARODIN HADJI SALIC Y GRANDE
JUDGEMENT Accused Camarodin Hadji Salic Y Grande stands charged of the crime of Violation of Section 2 of P.D. 1619 in an Information which reads as follows:
"That on or about the 14th day of March 2002, in the City of Angeles, Philippines and within the jurisdiction of this Honorable Court, the above-named accused, sis then and there willfully, unlawfully and feloniously sniff, smell, inhale and/or possess "rugby" which contain toluene, a volatile substance, in Violation of the Provision of Presidential Decree No. 1619." During his arraignment today accused manifested through his counsel Antonio Yao that he is willing to enter a plea of guilty invoking the mitigating circumstance of minority. This manifestation was duly confirmed by the accused in open court. The Court then ordered accused to be arraigned. Upon his arraignment, accused voluntarily entered a plea of guilty in this case. WHEREFORE, finding the accused, and by his own plea, guilty beyond reasonable doubt of the crime of Violation of Section 2 of P.D. No. 1619 and considering the mitigating circumstance of voluntary plea of guilty and the privileged mitigating circumstance of minority without the presence of any aggravating circumstance to off-set the same, the Court hereby sentences accused Camarodin Hadji Y Grande to an indeterminate imprisonment of six (6) months and one (1) day of prision correccional, as minimum, to four (4) years and one (1) day of prison correccional, as maximum. Considering that accused is a youthful offender, the execution of his sentence is hereby suspended. Considering further his admission that he is a drug dependent or user, and with the consent of his grand father Sultan Salic Grande, he is hereby placed for rehabilitation under the Central Luzon Drug Rehabilitation Center, Sto Nino Magalng, Pampanga, for a period of six (6) months or until he shall have been fully rehabilitated subject to the report and recommendation of the said Center.
