ORDER

When these cases were called, all the minors accused appeared assisted by Atty. Orlando Pangilinan who manifested that the minor offenders are willing to plead guilty to a lower offense of Vagrancy. This was not objected to by the prosecution through Pros. Lucina A. Dayaon.

When arraigned, all the accused pleaded guilty to Vagrancy, involving the privileged mitigating circumstance of minority and the mitigating circumstance of voluntary plea of guilty.

WHEREFORE, finding all the accused and by their own plea, guilty beyond reasonable doubt of Vagrancy, they are hereby sentenced each to an imprisonment of five (5) days of arresto mayor.

Accused are credited with their preventive imprisonment in the service of their sentence.

Considering that all the accused have been in jail since May 31, 2002 and they have already served their maximum sentence, they are hereby ordered immediately released to the custody of their respective parents, unless their further detention is warranted by law.

If their parents are not available, then the City Jail Warden is directed to release them to the custody of the Bahay Bata Center.

SO ORDERED.
