The latest resolution of the Department of Justice (DOJ) is the revival of a complaint filed by an American citizen Alan Dale Edmonds, former US base employee at Clarke against Fr. Shay Cullen. The complaint was already dismissed by the special investigating prosecutor. Who said in part ;
"After thoroughly evaluating the allegations of (name of child deleted) as well as the previous circumstances surrounding the case, we honestly believe that no probable cause exists against respondent for the crime charged for the following reasons;
1. At the very outset, it was ( a 12 year old house boy ) whom (the 7 year old ) was accusing of sexual abuse. This was the time when she told her teachers about the matter. . .
The prosecutor cites all the times before any allegation was made against Fr. Shay Cullen that the child told her teachers, the DSWD social workers and the police in San Antonio, Zambales in October 1997 that a 12 year old house boy and her half brother abused her ten times. The house boy confessed to Prosecutor Dorentino Floresta that he committed the crime February 3, 1998. He admitted that Edmonds kept pornographic videos in the house in San Antonio and that the two boys watched them when he was absent.
Preda is contesting the latest DOJ reversal of this resolution that failed to consider the overwhelming weigh of evidence pointing to the two boys as the abusers.
The resolution failed to consider the circumstances wherein it was impossible that she could have been abused at the Preda center since they never even established that Fr. Shay was in the child care center when the abuse was supposed to have occurred. Fr. Cullen can prove that he was elsewhere at the time. The child was in the care of Preda social workers and therapist in a secured facility and can testify that no such incident occurred whatsoever. Preda social workers videotaped the child telling a child therapist that the two boys abused her.
The accusation is based on a medical legal examination March 4,1998 that was made by the DSWD a full week after the child was transferred to their center from the Preda center , indicating that the abuse was done by the 2 boys before the child went to the Preda center or it occurred during her six days at the Lingap center where there are many boys mixing with the girls in the dormitory. This is unlikely as a previous medical examination at the San Marcelino hospital October 17,1997 showed abrasions had already occurred to her sexual organs.
It was during this time in the Lingap center that the child told the NBI March 5, 1998,that she was abused by the house boy and her half brother in the house in San Antonio, Alan Dale Edmonds, admitted in a court hearing and in an affidavit that the boys played with the child but they only played doctor and kissed her on the cheek.
Likewise the DOJ resolution failed to examine the circumstance under which the child was coerced to write the letter accusing Fr. Shay. A full year later, after making her original accusations against the two boys she was made write her letter accusing Fr. Shay. This was done on October 27, 1998 , after she was given back from the DSWD center by court order of Judge Eliodoro Ubiadas to the house where her abusers and their parents lived together.
Under this pressure from the father of the abuser and the mother of the house boy the child was made to blame Fr. Cullen by writing her letter in the Baloy beach bar of Harry Joost , the most severe critic of Fr. Shay and Preda and leader of the Paedophile support group fighting to get convicted Paedophile Keith Fitzgerald a new trial. Harry Joost, a German national, who has been charged with obstruction of Justice by Preda in relation to the Fitzgerald conviction.
In what was an elaborate attempt to frame up Fr. Shay Cullen the child was coerced to write an incriminating letter in the bar of Harry Joost on Baloy Beach Resort. This location alone ,where the letter was written, under very suspicious circumstances (documented by the Regional Commission of Human Rights, Pampanga) makes it clear that this was an effort to manufacture evidence. Many previous complaints brought by Edmonds and Joost against Fr. Shay and Preda staff had been repeatedly dismissed for lack of credible evidence. This time the were trying to make sure the false evidence would get filed in court.
This old case is being brought up as harassment to obstruct the work of Preda seeking justice for abused children by Paedophile suspects in the bars and brothels of Olongapo city. Fr. Shay has campaigned for 26 year for children's rights and is a Nobel Peace Prize Nominee and a winner of the German Human Rights Award of the City of Weimar this year.
Members of the Paedophile support group of Fitzgerald have made 50 false
charges against Preda staff over the past two years, most have been dismissed as
baseless and harassment. Edmonds made thirty (30) of the false allegations
against Fr. Cullen.
