Australian behind ‘Daisy’ sex videos charged

MANILA (UPDATED) -An Australian national and his alleged cohorts behind the controversial “Destruction of Daisy” sex and physical abuse videos, with Filipina girls as victims, were slapped with various criminal offenses, among them murder and rape, before the Department of Justice (DOJ) on Friday.

The National Bureau of Investigation Anti-Human Trafficking Division (NBI-AHTRAD) filed a 16-page complaint against Peter Gerard Scully and his former live-in partner, Liezyl Margallo, for murder, punishable under Article 248 of the Revised Penal Code; violation of Republic Act (RA) No. 8353 (Anti-Rape Law of 1997); and violations of RA No. 9208 (Anti-Trafficking in Persons Act of 2003), RA No. 10175 (Cybercrime Prevention Act of 2012), and RA No. 7160 (Special Protection of Children Against Abuse, Exploitation and Discrimination Act of 1992).

Charged with them are German national Christian Rouche, Alexander Lao (Filipino), and Althea Chia (Filipino).

The case involves the alleged sexual and physical abuse, including torture, of eight Filipina girls, with ages ranging from 1-13 years old, in Cagayan de Oro City from April 2011 up to September 2014. The abuses were recorded with the use of a digital camera and uploaded on a porn website.

“Apparently, [these videos] have been known to the international law enforcement community for quite some time. Inquiries… to foreign law enforcement officers revealed that the said [videos] contained serious sexual abuses and physical torture on children believed to be from the Philippines by an unidentified Asian-looking woman and her unidentified male Caucasian accomplice.

“In addition to the ‘Destruction of Daisy’ videos, there are also video clips of at least 5 or 6 innocent children being sexually abused,” the complaint read.

The NBI-AHTRAD and the DOJ Office of the Cybercrime (DOJ-OCC) began its investigation after foreign law enforcement counterparts informed a Philippine contingent of a so-called “Daisy Video Case” during an INTERPOL Human Trafficking Conference in Bermuda in October 2014.

Philippine authorities were assisted by the National Police of the Netherlands, which had earlier investigated the “Daisy Video Case” and already possessed a case file containing photographs of the victims, the male and female suspects, and the interior of the houses where the abuses took place.

The investigation by Philippine authorities was fast-tracked by a pending case against Scully before Cagayan de Oro Regional Trial Court (RTC) Branch 37 for the sexual and physical abuse of two Filipina girls, aged 9-year old and 12-year old, dubbed as the Apovel case for reportedly having been committed at Apovel Subdivision in Barangay Buluan.

The two victims were able to escape and narrate their ordeal to their parents, which led to the filing of the case. The RTC had issued 6 warrants of arrents against Scully in connection with the Apovel Case, for 5 counts of rape and one count of qualified trafficking-in-persons.

Scully’s alleged cohort in those incidents, Carme Ann Alvarez, was nabbed and detained at the Cagayan de Oro City Jail.

TRACING THE CRIME AND THE MAIN OFFENDER

NBI-AHTRAD agents were able to secure Alvarez’s cooperation, which led to the examination of two of Scully’s hard drives by the Australian Federal Police (AFP). The assistance of the AFP was sought after it was informed that an Australian national was the subject of the investigation. Alvarez was also instrumental in tracing the houses that Scully and Margallo rented.

NBI-AHTRAD agents were able to locate Margallo and served subpoenas on her upon her arrival at the Ninoy Aquino International Airport (NAIA) Terminal 3 on February 19, 2015 where she was scheduled to depart for Cagayan de Oro.

“Margallo readily offered to help the NBI to locate him (Scully). As the information Margallo was offering might lead to the arrest of Scully, a dangerous fugitive, the undersigned affiants (NBI-AHTRAD agents) were left with no choice but to accept the offer of Margallo. Margallo then offered to lead the NBI to a barangay in Malaybalay, Bukidnon where she last met with Scully a couple of months back,” the complaint read.

The next day, February 20, 2015, NBI agents arrested Scully, by virtue of the 6 outstanding arrest warrants issued by the Cagayan de Oro RTC, inside a house in Purok 2, Barangay Violeta, Malaybalay.

“On February 22, 2015, subject Liezyl Margallo, accompanied by counsel Atty Enrique Malicay, Jr., appeared at the NBI Regional Office… Margallo volunteered information on the crimes allegedly committed by her former live-in partner, Peter Gerard Scully, that she has personal knowledge of,” the complaint read.

Margallo claimed that Scully sexually and physically abused the girls, and Scully and Rouche “both sexually abused the girl ‘Barbie.'” Barbie was later killed and buried in the kitchen of a house in Surigao rented by Scully and Margallo, according to the latter. Margallo accompanied the NBI to the house where a human skull and bones were later exhumed.

Margallo also admitted to bringing children to live with her and Scully, and performing in one of the videos subject of the investigation.

In its complaint, the NBI described one of the acts in the videos as “unprecedented in the history of child abuse investigations.”

The complaint was transmitted to the DOJ by NBI Director Virgilio Mendez.
